Terms and Conditions
These are my general terms and conditions.Each type of commission might have some varations so make sure to read them before ordering on VGen.If you want comercial rights, it must be disscused before proceding with the commission.By commissioning me you agree to the following Terms of Service.
1. GENERALCommissions are for personal use only, allowing streaming usage if stated in the ToS of the service.
For commercial work, the prices would be higher than those applied for a normal commission, and must be discussed before accepting. If you are looking for a commission for professional use you must specify it in the information.All commissions come in a digital file, you won't receive a printed version of the artwork.Client:
• Must provide enough references and information.
• Agrees that the material and character/s provided have been legally adquired and can be used as reference for your commission.Artist:
• Reserves the right to not accept or cancel your order if you don't meet the conditions, you are someone suspicious, have bad behavior or rush the artist.
• Have the right to not accept commissions based on content that is offensive or inappropriate.
• Only make drawings with my style. *If commercial work it can be disscussed.I'm not comfortable drawing:
• Explicit NSFW (nudity is fine)
• Visceral Gore (Blood is fine)
• Mechas2. PAYMENTSFull payment must be done in advance. *For commercial work it can be discussed
Commissions through Vgen must be paid through Vgen.3. REVISIONSThe sketch of your commission will be presented before proceeding to the lineart phase for your approval, and to fix any possible mistakes or apply minor changes that may arise.After this, further revisions for minor changes or corrections are free of charge. Big changes to the artwork would suppose an extra cost which may vary based on the number and complexity of those changes.Once the drawing is finished, I will only accept very minor changes or corrections. Any major changes will cost an extra fee or may be directly rejected.Examples of minor changes include:
• Color correction
• Accessories
• Clean-up
• Small changes in light or shadowsExamples of major changes include:
• Pose, composition, background and any other change that requires heavy line and color rework.Revisions may increase delivery time.4. DEADLINES AND DELIVERYOnce I start your commission, it'll take around 1 to 5 weeks to finish, it may vary depending on its complexity.
The time I take to begin may differ depending on the number and volume of pre-existing commissions.If you have a deadline you must specify it before starting and it'll cost an extra fee. This fee will vary depending on the urgency of your commission. Rush orders must be agreed on beforehand and I have the right to decline them.Once approved, you'll receive the illustration in .png format with its original size, without any watermark/signature.You'll also receive a web version with lower quality and a watermark. You must use this version if you want to upload it to your socials and must always add proper credits.After I send you the finished commission, you are responsible of downloading the file and keeping it. I’m not responsible for lost artworks if more than 6 months have passed.5. USEYou can re-upload the illustration if you credit me properly, but you can't claim that you or any other person, artist, or entity has made it. You can't modify this illustration if it has not been previously discussedYour commission is only for personal use (avatar, wallpaper, etc) unless commercial use is specified, which will cost an extra fee.As the artist, I have the right to upload the illustration on my websites and social media pages. You will receive your respective credits as the commissioner of the work.6. INTELLECTUAL PROPERTY RIGHTSAs the artist I reserve the intellectual property rights of my works and I can use them for my portfolio, websites and social media pages.
I can upload the commissioned artwork to my social media sites, unless a mutual agreement has been reached between me and the commissioner.The client can't:
• Modify the artwork
• Claim it as their own or as the work of any other person, artist, entity, etc.
• Use it in any form of commercial usage (selling, advertising) without being agreed on beforehand.
• Use it as basis for any kind of neural network/AI training/machine learning, etc.Usage of my work for AI, machine learning, NFT, blockchain, other for-profit platforms/purposes and any other extant or future technology that, following European regulations, violates IP rights is strictly prohibited.These restrictions are applied to all phases of the commission, including the sketch.7. REFUNDSIf you cancel your order before I start I'll refund you for the full price of the commission. If I have finished the sketch it'll be 50%. Once I have finished the line art there won't be any refund.Any breach of contract at any phase of the commission will terminate your right for a refund.8. ACCEPTANCE
Client is 18+ and legally able to commit to an agreement.
If you are a minor, the contract must be accepted and agreed upon by your legal guardian.9. COMMUNICATION
Feel free to ask me for any information regarding your commission or to give additional details.
I'm fine showing updates but only if needed or if a long time has passed since the last update.In the event of any complication or issue that may impede me from finishing your commission (i.e., real life injury), you will receive a full refund of your commission. Remember that any intellectual property rights still apply, even for the unfinished work.Ongoing communication will be prevalent throughout the project.
Communication may be done through email or VGen for commissions ordered in there.Artist's response may take up to 3 days.
If there is no response from the client's side for 1 month, the client will lose their rights to any refund, except for reasons of force majeure

Estos son mis términos y condiciones generales.Según la comisión que elijas habrá alguna variación, asegúrate de leer los TyC en VGen antes de hacer el pedido por ahÃ.Si quieres derechos comerciales deberás especificarlo y habremos de discutirlo antes de empezar el encargo.Al hacerme un pedido y comprar mis servicios automáticamente estás aceptando estos Términos y Condiciones.
1. GENERALLas comisiones son sólo para uso personal, pudiendo usarse para streaming si asà aparece especificado en el servicio. Para uso comercial los precios serán mas altos y se deberán discutir antes de aceptar la comisión. Si estás buscando una comisión para uso comercial deberás especificarlo en el formulario / email.Las comisiones son entragadas en formato digital, no se entregará ninguna versión impresa del mismo.Cliente:
• Debe proporcionar las referencias e información necesarias
• Confirma que el material y personaje/s han sido adquiridos legalmente o pueden ser usados en el encargo.Artista:
• Se reserva el derecho de denegar o cancelar tu petición si no cumples las condiciones, eres alguien sospechoso, tienes mal comportamiento, etc., o si el contenido de la comisión es ofensivo o inapropiado.
• Los dibujos son en el estilo del artista. *Para trabajo comercial se puede consultar.No estoy cómoda dibujando:
• NSFW ExplÃcito (se aceptan desnudos)
• Gore visceral (se acepta sangre)
• Mechas2. PAGOSe debe realizar el pago completo antes del inicio de la comisión. *Para trabajo comercial se puede consultar.
Las comisiones encargadas por VGen se deben pagar por la página de VGen3. REVISIONESSe entregará el boceto del encargo antes de proceder con el lineart para su aprobación, podrás señalar cualquier error que se deba corregir o cambios que se deban aplicar.Después de esto, pequeñas correcciones o cambios son gratis, cambios más grandes tendrán un coste extra que variará según el volumen del cambio/s.Una vez acabado el dibujo, solo se aceptaran pequeños cambios y correcciones, los cambios grandes tendrán un coste extra y podrán ser denegados.Ejemplos de cambios pequeños:
• Corrección de Color
• Accesorios
• Limpieza
• Pequeños cambios en luz y sombraEjemplos de cambios grandes:
• Pose
• Composición
• Fondo
• Cualquier otro cambio que requiera mucho trabajo de linea y color.Las revisiones pueden incrementar el tiempo de entrega del encargo4. PLAZO DE ENTREGA Y RECEPCIÓNUna vez empiece tu comisión, tardaré alrededor de 1 a 5 semanas en acabar, dependiendo de la complejidad del encargo.El tiempo de espera para empezar con el encargo variará en función del volumen de comisiones existentes.Si necesitas una fecha de entrega concreta deberás especificarlo antes de empezar y puede acarrear un coste extra. Este coste extra variará dependiendo de la urgencia de la comisión. Este tipo de encargos se deberán hablar antes de empezar y tengo el derecho de denegarlos.Una vez completo el encargo, recibirás la ilustración en el formato especificado en el servicio (normalmente en .png) en su tamaño original y sin marca de agua.También recibirás una versión web con calidad reducida y marca de agua para compartir en redes. Debes usar esta versión si quieres compartir la ilustración en internet y adjuntarla con los créditos correspondientes (artista, diseñador, etc.).Tras enviarte la ilustración final, eres responsable de descargarla y guardarla en un lugar seguro. No soy responsable de las ilustraciones que se puedan perder si han pasado más de 6 meses.5. USOPuedes subir las ilustración siempre y cuando me acredites, no puedes proclamar que tu ni otra persona la ha realizado. No puedes modificar la ilustración si no se ha acordado con anterioridad.La comisión es sólo para uso personal (avatar, fondos de pantalla, etc) salvo cuando se acuerde un uso comercial, que tendrá un coste extra.Como el artista, tengo el derecho de subir las ilustraciones a mis páginas y redes sociales, adjuntando los respectivos créditos del cliente.6. DERECHOS DE PROPIEDAD INTELECTUALComo el artista me reservo los derechos de propiedad individual de mis trabajos y podré usarlos en mi portfolio, página web y redes sociales.Puedo subir el arte comisionado a mis redes sociales y sitios web a no ser que se haya llegado a un acuerdo anteriormente o se trate de un encargo privado, que acarrea un coste extra.El cliente no puede:
• Modificar la ilustración
• Proclamar que es su obra o el de otra persona o entidad.
• Usarlo de forma comercial sin haberlo discutido previamente
• Usarlo como base para entrenamiento de IA/machine learning, etc.El uso de mi arte para IA, machine learning, NFT, blockchain o cualquier otra plataforma o propósito con animo de lucro y cualquier tecnologÃa futura de similares caracterÃsticas que viola derechos de IP según regulaciones Europeas queda terminantemente prohibido.Estas restricciones aplican a todas las fases del encargo, incluido el boceto.7. DEVOLUCIONESSi cancelas el encargo antes de empezar con él, la devolución es del 100% del precio de la comisión. Si he acabado el boceto, será del 50%. Una vez finalizado el lineart no se aceptan devoluciones.Cualquier incumplimiento del contrato en cualquier fase de la comisión rescindirá su derecho a una devolución8. ACEPTACIÓN
El cliente tiene más de 18 años y puede legalmente comprometerse a un acuerdo.Si eres menor, el contrato lo debe revisar y aceptar tu tutor legal.9. COMUNICACIÓN
Puedes preguntarme por tu encargo o dar información adicional en cualquier momento.
No tengo problema en mostrar actualizaciones del encargo cuando sea necesario o si ha pasado un tiempo considerable desde la última actualizaciónSi ocurriera alguna complicación o imprevisto que me impidiera acabar tu comisión, recibirás un reembolso completo del encargo. Recuerda que los derechos de propiedad intelectual siguen aplicando aún si el trabajo no está completado.La comunicación será continua durante todo el proyecto.
La comunicación se hará por el método elegido al inicio, teniendo preferencia el email o VGen para los encargos realizados ahÃ.El artista puede tardar hasta 3 dÃas en contestar.
Si no hay respuesta por parte del cliente en 1 mes, el cliente pierde sus derechos de un reembolso, salvo causas de fuerza mayor.
